Nomination of Chair

Minutes:

Councillor Collins nominated himself as Chair of the Licensing Committee to Chair the Sub-Committee. This was seconded by Councillor Ralph and agreed by Councillor Fish.

 

RESOLVED:

 

That Councillor Collins Chair the Sub-Committee.

The Chair of the Sub-Committee advised all present of the process of the hearing. He then invited the Licensing Officer to introduce the report as outlined within the agenda on pages 5 to 26.

 

Members and Essex Police were provided the chance to ask questions of the Licensing Officer. 

 

Mr McManus was then provided the opportunity to present the case on behalf of Essex Police during which Members heard how the Premises Licence Holder Mr Garwood who was also the DPS was no longer involved in the premises and hadn’t been for some considerable time. Essex Police had learnt this through their follow up investigations arising out of the assault.

 

The Senior Licensing Officer for Essex Police continued to explain the role of DPS was in the process of being handed across to Mr Loveday who was acting as the manager of the premises.  Members were advised on the 14 of July, Mr Loveday had allegedly assaulted a customer using a knuckle duster, causing quite severe injuries. He had been arrested and charged with the offence awaiting a court case, as part of his bail conditions, Mr Loveday had been given a curfew.

 

He told the Sub-Committee it was Essex's police's position that as the premises was now unsupervised and as there was no management structure in place, they were seeking an opportunity to work with the new premises licence holder and potential DPS to stop any such crime and disorder taking place in the future. With this in mind they were asking for a suspension of the licence until a full hearing was heard to give everyone an opportunity come back to Essex Police with conditions which could be worked with.

 

Members and the Licensing Officer were provided the chance to ask questions of Essex Police.  There were none from the Licensing Officer.

 

The Chair enquired if the weapon used in the assault had been found. The Senior Licensing Officer for Essex Police advised the last update he had on the investigation; the weapon that was used was not recovered. However, Essex Police had evidence that it was seen by independent parties. He continued to advise the CS spray which was recovered was not involved in the assault.

 

It was confirmed that all parties had said everything they wished too.

 

The Sub-Committee adjourned at 11.18am for deliberations and were accompanied by the Legal Advisor and the Democratic Services Officer. 

 

The meeting reconvened at 11.18am.

 

RESOLVED:

 

To suspend the licence with immediate effect. A full review of the licence is to take place within 28 days from the original police application.
