To receive additional items that the Chair is of the opinion should be considered as a matter of urgency, in accordance with Section 100B (4) (b) of the Local Government Act 1972.

There were no items of urgent business.

The Chair asked all parties if they had any requests, and it was noted that there were no requests.

The Licensing Officer introduced the report to Members of the Sub-Committee informing them, the report was for the determination of a Private Hire Driver Licence.

Members and the applicant were provided the chance to ask questions of the Licensing Officer. There were none from the applicant.

Licensing Officers from Essex Police addressed the Sub-Committee to outline their case.

All parties were provided the chance to ask questions of the Licensing Officer of Essex Police. There were none from either party.

The applicant was then provided with the opportunity to present his case.

However due to technical difficulties, an adjournment was suggested and requested by the applicant.

RESOLVED:

The Sub-Committee agreed to adjourn the hearing due to technical difficulties.

The Chair then moved on to closing summaries.

The Licensing Officer provided a short summary to the Sub-Committee and in doing so advised the applicant did not meet the Licensing criteria under Thurrock Council’s pre licensing standards regarding providing satisfactory Criminal Record checks. She continued by explaining Under Section 51 (1)a, Local Government (Miscellaneous Provisions) Act 1976, the council shall not grant a licence unless they are satisfied the application is a fit and proper person to hold such a licence,  it was therefore for the Sub-Committee to decide whether the applicant was a fit and proper person to hold a Hackney Carriage Driver’s licence.

The applicant was asked to present a summary of his case to Members; during which during which he stated he wished to work or Thurrock as he was living in the area and working for TFL, the office took 25% of his earnings.

The Chair asked if there were any further questions, there were none.

The Sub-Committee adjourned at 8.00pm for deliberation and were accompanied by the Legal Advisor and the Democratic Services Officer. 

The meeting reconvened at 8.15pm.

RESOLVED:

The Sub-Committee agrees to refuse the Hackney Carriage Driver’s licence.
